Art. 142 co. 6 CdS does not set the tolerance: it defers to «il regolamento di esecuzione». That regulation is D.P.R. 495/1992, and the rule is in its art. 345 co. 2. The reduction applies to the recorded value BEFORE the band is chosen.

The reduction is the greater of 5% of the recorded value and 5 km/h. The two branches agree exactly at 100 km/h: below it the flat floor binds, at or above it the percentage does. You can check this arithmetic yourself.

The device's own margin of error is already inside this reduction. A second one is never added.

What this calculation does not cover

Art. 345 co. 3 sets a different regime for average speed computed between two motorway toll gates, with separate percentages by deduced speed band. That rule exists, and our model does not represent it: it concerns an enforcement method distinct from fixed and hand-held cameras. We are stating the scope of our model, not a silence in the law.

What this page does not claim

We do not say that a given notice applied the reduction, that a given device is type-approved, or that a tolerance argument wins an appeal. The reduction is prescribed «in sede di approvazione» of the apparatus and applies to the recorded value: that is what the provision says.

The art. 142 bands apply the same way on every type of road — built-up area, extra-urban route or motorway: what changes is the speed limit itself, never this fine table. The "built-up area" row below does not mean these amounts only apply in town: it is the only one the Code provides, because the statute does not set a second table by zone.

Change pending

The decree is due by 1 December 2026 and takes effect on 1 January 2027, indexed to the ISTAT variation for the 2025-2026 two-year period. We predict no figure: the index cannot be ascertained until the period closes, the decree does not exist, and the mechanism's suspension has already been extended several times. A predicted figure here would be an invention.

In brief

The figure on the notice is not the figure the band is chosen from

An Italian speeding notice states a recorded speed — the number the device produced — and it states the speed limit that applied. Neither of those is the number that picks your penalty band. Between them sits a deduction that the implementing regulation makes compulsory, and it is applied to the recorded value before anything else happens.

The rule is in D.P.R. 495/1992 art. 345 co. 2, which is where CdS art. 142 co. 6 sends you when it says that speed-measurement devices are governed by «il regolamento di esecuzione». The reduction is 5% of the recorded value with a floor of 5 km/h, and it already contains the device's own margin of error. Nothing further is subtracted afterwards, by anybody.

This matters most at the edges. The bands are integer ranges, so a recorded speed sitting a couple of km/h inside one band can land in the band below once the deduction is taken — a different amount, a different points value, and sometimes the difference between a fine and a suspended licence. That is the whole reason this site starts from the recorded figure rather than from the excess.

The two branches meet at one speed, and you can check it

The deduction is whichever is larger: 5% of the recorded value, or the flat 5 km/h floor. Those two agree exactly at 100 km/h — below that speed the flat floor is what actually binds, at or above it the percentage takes over and the floor never binds again. That crossover is arithmetic, not a separate rule, and it is the one number on this page you can reproduce with a calculator.

The figures

Four bands, and what each one carries besides money

Art. 142 sets 4 bands, and they do not change with the type of road. A motorway, a main road and a street in a town all read from the same ladder; what changes between them is the limit itself, not the penalty band.

The first band, up to 10 km/h over the limit, carries a payable figure of € 42 and no points at all. The second, more than 10 and not more than 40 km/h over the limit, is where the licence starts to be touched: € 173 to pay and 3 points. The third, more than 40 and not more than 60 km/h over the limit, is € 543, 6 points, and an accessory suspension whose statutory floor is 1 month. The top band, more than 60 km/h over the limit, is € 845, 10 points and a suspension starting at 6 months.

Points begin at more than 10 km/h over the limit; a suspension begins at more than 40 km/h over the limit. Those are two different thresholds and readers routinely merge them. Below the first one the money is real and the licence is untouched; between them the licence loses points but keeps working; above the second one an accessory sanction attaches and the whole payment picture changes with it.

Paying it

The payable figure is the floor of the corridor, not a discount

Every one of those amounts is a corridor in the statute — a minimum and a maximum — and the figure you are asked for is the minimum. Art. 202 co. 1 calls it «una somma pari al minimo fissato dalle singole norme»: a sum equal to the minimum the individual provision sets. It is not a reduction from the maximum and it is not a concession; it is the floor of the range the charged article already contains.

The window for it is 60 days from the date the notice was served on you or handed to you at the roadside. Inside the first 5 days a further 30% comes off — but only where the offence carries neither confiscation of the vehicle under art. 210 co. 3 nor suspension of the licence. Because so much of the catalogue carries a suspension, that further reduction is the exception rather than the rule, and on the two heaviest speeding bands it is simply not available.

If you pay by bank transfer rather than in cash or by postal giro, what counts is the date the administration's account is credited, not the date you pressed send. The rule allows 2 days for that credit to land past the deadline. From abroad, with an intermediary bank in the chain, that is the difference between a payment that is timely and one that is not.

In detail

Three things that move the figure, and one that does not

A repeat inside a built-up area has its own rule. Where the second band is breached at least twice within 12 months in a built-up area, art. 142 co. 8 substitutes its own corridor, from € 220 to € 880 — € 220 payable — and adds a suspension measured in days rather than months, 15 to 30 days. It is the only suspension figure in the Italian speeding rules stated in days.

Vehicle class doubles it. Art. 142 co. 11 doubles both the pecuniary sanction and the accessory sanction for the 7 vehicle classes art. 142 co. 3 lists — heavy goods vehicles, buses over a stated weight, vehicle-and-trailer combinations, dangerous-goods loads and work vehicles at full load. It never doubles the points: those come from a separate table that co. 11 does not touch.

Night moves it too, but only for named articles. Art. 195 co. 2-bis increases the pecuniary sanction by a third for violations committed between 22:00 and 7:00 — and it applies to a closed list: artt. 141, 142, 145, 146, 149, 154, 174, 176 (commi 19 and 20) and 178. Speeding is on that list. Nothing else is on it by analogy.

What does not move it: the road. There is no separate motorway table in Italian speeding law, and a page that offers you one is describing a different country's system.

One tolerance regime is not modelled here

Art. 345 co. 3 sets a second, structurally different tolerance for average speed computed between two motorway toll gates, with its own percentages keyed to the deduced speed. It is a real rule and it exists; our model does not represent it, because it belongs to an enforcement method distinct from fixed and hand-held cameras. This is a statement about the reach of our calculation, not about a silence in the law.

If the vehicle is registered outside Italy

Art. 207 lets an officer take the reduced payment on the spot from a foreign-registered vehicle. Where that is not done, a deposit is required — measured against the maximum of the applicable range for a non-EU plate, and against the reduced-payment figure itself for a vehicle registered in an EU or EEA state. If no deposit is paid the vehicle can be held administratively until it is. The article states the ceiling on that period; our data set does not carry the day count, so we name the provision rather than print a number we have not sourced.
