Open anomaly

Two anomalies we leave open

Open anomaly

Two different scales for one article

The text of art. 167 co. 3, as amended, states overload bands that do not match the ones printed in the points table annexed to art. 126-bis, which stayed on the earlier bands. We render both scales as written.

Bands in the article's own text
  • 5%
  • ·15%
  • ·25%
  • ·> 25%

For the article's own text our data records the bands, not a verbatim transcription: we print the quotation where we hold one and never invent one where we do not.

Tabella allegata all'art. 126-bis

For the article's own bands we assert NO points value: the table is built on a scale the article no longer uses, and mapping one onto the other would be our invention. Referred to the reviewer.

Open anomaly

Three rows with a leading minus

In the official table the art. 173 rows are printed with a leading minus, while almost every other row of the same table is an unsigned positive. We use the magnitudes and disclose the anomaly: we do not silently correct it, and we do not claim to know which reading is right.

Finding your row

What this tool does, and the one thing it cannot do

It works on deductions and recovery: what a violation costs from the annexed table, how the cap behaves when several are established at once, and what the recovery mechanisms restore. It starts from the allocation of 20 points the statute gives a new licence.

It cannot read your balance. Nobody outside the Italian register can — the balance is held by the Motorizzazione and shown through the Portale dell'Automobilista, the IO app or the Motorizzazione helpline, each of which requires you to identify yourself. Any site that offers to look up your points from a plate number is offering something it does not have.

So the honest use of this tool is planning and checking: comparing what a notice says was deducted against what the table provides, and understanding what a second or third violation would do.

The figures

How the cap interacts with everything else

Where several violations are established at the same time, the total deduction is capped at 15 points — unless suspension or revocation is ordered for the violation, in which case the cap does not apply at all and the full deduction stands.

Newly qualified drivers sit on top of that. Within 3 years of a first category-B-or-higher licence, the table's values are doubled — a rule that lives in the closing note beneath the table rather than in art. 126-bis itself. The same note provides the opposite direction too: a year inside that window without a deduction-bearing violation earns 1 point, up to 3 points. The note ties that credit to the general clean-period regime without stating how the two interact numerically, and we do not infer an interaction the text does not give.

A separate escalation applies to suspension DURATION rather than to points. Art. 218-bis increases the length of an accessory suspension by a third on a first violation within 3 years of a category-B licence, and doubles it for later ones — with the window extending to 5 years where a violation in the first period itself carried a suspension longer than 3 months. Points doubling and suspension escalation are two independent regimes that share a trigger and are never one rule.

How it works

Recovery, in the order it actually happens

Courses restore points on completion of an examination, not on attendance: 6 points for the standard course, 9 points for the professional one. They are the fast route and the only one available to a driver who cannot afford to wait out a clean period.

Time restores more. 2 years without any deduction-bearing violation returns the balance to 20 points, and a holder already there accrues 2 points for each 2-year clean period up to 10 points — the derived ceiling of 30 points that the statute never states as a figure.

And at the floor the mechanism stops being about points: art. 126-bis co. 6 requires the technical fitness examination under art. 128, with suspension for an indefinite period if the holder does not comply within 30 days of notification.

The deduction on your notice may not match the table row you expect

The table frequently keys its rows to the comma describing the CONDUCT rather than the comma imposing the fine, and several articles carry different point values for different underlying conduct under a single fine corridor. A mismatch between the notice and a table row you found is more often a question of which row applies than an error — which is why the row wording on this site is kept exactly as the source prints it.

In detail

How a deduction reaches your record, and how you learn about it

A deduction is not applied by the officer at the roadside. The enforcement body communicates the violation to the licence register once the position is settled, and the register applies whatever the annexed table provides for the article charged. That is why a notice can be paid and the points appear afterwards, and why the balance you check today may not yet reflect a notice you paid last week.

Where the driver was not identified at the roadside — a camera detection, an unattended vehicle — the register cannot deduct from anyone until it knows who was driving. That is the gap art. 126-bis co. 2 closes: the owner must supply the driver's personal and licence details within the period that comma sets, and failing to do so without a documented reason is a separate offence with its own corridor. Hire companies comply as a matter of routine, which is why the points from an Italian holiday can follow a driver home even when the money was settled by the rental firm.

For a driver who holds an Italian licence the practical consequence is simple: check the balance at the register rather than inferring it from your own arithmetic, because what the register did is the fact, and what the table says it should have done is what this tool models.

A deduction and a suspension are different consequences of one event

Where an article carries both, both happen: the table's points come off and the prefect orders the accessory suspension, on their own clocks. The one interaction that matters is the cap — 15 points for a single occasion — which is disapplied entirely when suspension or revocation is ordered, so the two never soften each other.
